Purpose
When disagreements arise within Waves of Love Foundation, dba Center for Child-Safe Divorce ("Organization"), the first step is good-faith mediation with a neutral, licensed professional, not legal action. This applies to directors, officers, advisors, contractors, team members, and volunteers.
Scope
To respond to you, send updates you request, process donations and receipts, manage registrations, improve the site, and meet legal requirements.Covers interpersonal, governance, and operational disagreements, such as agreements, roles, boundaries, decision-making authority, communication, or strategy. It does not cover reports under the Whistleblower Policy. Suspected fraud, financial misconduct, legal violations, and child-abuse reporting go directly to the Compliance Officer and, if required, legal counsel or authorities, not to mediation.
Guiding Principle
A neutral Mediator, not an attorney, is the default. The Mediator helps the parties reach their own agreement and does not decide fault, issue binding rulings, or give legal advice. Anyone may consult their own attorney at their own expense.
Process
• Direct conversation: raise the concern clearly and in good faith with the other party.
• Facilitated discussion: either party may ask the Board President or Secretary (whichever is not involved) to facilitate.
• Formal mediation: either party or the Board may refer the matter to an independent, neutral Mediator who is not a director, officer, employee, or the Organization's legal counsel, selected from members in good standing of the National Mediation Society of America practicing in Napa, California.
• Written outcome: any agreement is put in writing and signed, and is binding only as the parties expressly agree.
• Governing law: California law; unresolved disputes are filed in state or federal court in Napa County, California.
Confidentiality
Mediation discussions are confidential except to document a signed agreement, as required by law, or if the matter falls under the Whistleblower Policy.
Costs
The Organization pays the reasonable cost of the Mediator unless the Board decides otherwise. No one is required to hire an attorney.
Limits
This policy does not replace the Whistleblower Policy, the Conflict of Interest Policy, or
mandatory reporting. Mediation is never required before reporting.
